PRIVACY POLICIES
Bullseye Buttons of Lehigh Acres, Florida may ask you to provide information
that personally identifies you or is otherwise personally identifiable in
certain circumstances, including, for example: when you upload or download
files, when you ask us to respond to an inquiry or when you submit information
on our feedback form (Personal Information). Examples of Personal Information
are your name or business name, billing and shipping address, zip code, phone
number, email address and credit card numbers. If you refer someone to us, you
may also be providing some of their information as well.
Use of Your Information
Bullseye Buttons uses your
Personal Information for two primary purposes:
- To enable graphic files to be uploaded to us from you to expedite the initiation of your order, or to enable you to download, view or print information contained on our site to assist you in creating graphics that can then be produced by us; and/or
- To respond to specific product, pricing, billing, website, service or other inquiries you may have regarding Bullseye Buttons and our business practices.
We will not sell or rent your Personal Information, nor will we provide to
third parties your Personal Information unless we have your consent, unless
sharing your Personal Information is required to provide the product or service
you have requested, such as to our credit card gateway Authorize.Net or to
PalPay merchant services or to our merchant account provider, Merchant Focus.
We will disclose your Personal Information to the extent required in response to subpoenas, court orders or other legal processes, or if we find
that your actions on www.bullseyebuttons.com violate any terms of use, any usage
guidelines for specific products or services, or any breaches of copyright,
trademark or service mark infringement which may be beyond our limits of
knowledge.
Bullseye Buttons does not endorse any type of email marketing from the
company itself, unless initiated from an opt-in customer selection, and to better improve the quality of Bullseye Buttons, we take a
firm position against all unsolicited email-based marketing activity. If you've received an
unsolicited email from an entity purporting to be Bullseye Buttons, please
report it immediately by forwarding a copy of the email to
privacy@bullseyebuttons.com.
From time-to-time, Bullseye Buttons may make available to you, on our
website, certain promotional rates, discounts or coupons which may require
registration or sign-up in order to receive these promotional rates, discounts
or coupons. We also maintain lists of referring and referred customers in order
to extend our "discounts on future orders" standing promotion to those
participants. However, you will always have the option to unsubscribe to any
emailing list to which you have subscribed by simply calling us toll free or
emailing us at
unsubscribe@bullseyebuttons.com.
Cookies
In addition to collecting Personal Information, we may set and access 'cookies' on your computer. A cookie is a small amount of data, often including an anonymous unique identifier that is sent to your computer's browser from a web site and stored on your hard-drive. However, your browser has modifiable preferences which allow you to accept all cookies, reject all cookies or notify you when a cookie is set. In order to protect your privacy, your browser only permits a web site to access cookies it has sent to you, not the cookies sent to you by other sites.
If you set your computer to reject all cookies, you may not be able to use
certain portions of our site, now or in the future, that require you to 'sign
in' to allow access to the www.bullseyebuttons.com cookie set on your browser.
Bullseye uses its own cookies, if at all, for a limited number of purposes, and
all Personal Information that may be included in the cookie is subject to this
Privacy Policy. Examples of uses include accessing your Personal Information
when you 'sign in' so that we can provide you with customized content; keeping
track of preferences as you are using our site; estimating and reporting traffic
information on our site; and conducting research to improve our content and
services. Other uses may also occur.
Child Privacy
In accordance with The Children's Online Privacy Protection Act of
1998, Bullseye Buttons does not knowingly collect or maintain personally
identifiable information or non-personally identifiable information on our site
from anyone under 13 years of age, and no part of our website is directed to
persons under 13. If you are under 13 years of age, please do not use or
access our website at any time or in any manner. If Bullseye Buttons learns that
information of persons under 13 years of age has been collected on our site
without verified parental consent, then we will take the appropriate action to
delete this information.
Securing Your Information
When you place orders with Bullseye, we use commercially reasonable and
generally-accepted technological safeguards to secure any information we collect
about you. Your credit card information is transmitted through our payment
gateway using a 128-bit Secure Sockets Layer (SSL) protocol, and the processing
company is compliant with a number of government and industry security
initiatives. Authorize.Net and its parent company CyberSource validate security
measures against applicable sections of numerous federal and state laws – HIPAA,
GLBA, California Senate Bill 1386 (SB1386), and many others.
TERMS & CONDITIONS
Please read the sales conditions contained herein for the purchase of any
products you have selected. If you have any questions regarding the following
terms and conditions, you should not place any orders until you have satisfied
your understanding of our procedures. If you do not agree to the terms and
conditions of payment, please do not place any orders.
Bullseye Buttons will not
begin production on any order until we have written approval to go
ahead
from the party responsible for payment AND the total payment in full.
No refunds, returns or exchanges will be made, other than as described in
detail on our
F A Q page, and as reprinted below:
If you cancel your order after it has been shipped,
no refund will be issued.
If you cancel your order after it has been
completed but not shipped, no refund will be issued OTHER THAN shipping
charges and any applicable sales tax that was billed to your credit card.
Shipping charges and sales tax will be refunded IN FULL.
If you cancel your order after production has begun, we will issue a refund in
the amount of 25% of your total order, less shipping and taxes. Shipping
charges and sales tax will be refunded IN FULL.
If you cancel your order and it has not been placed into production,
we will issue a refund of your order IN FULL, including shipping and taxes,
less a $20.00 cancellation
charge.
Our product is customized for you alone and, as such,
is not returnable. It is the customer's responsibility to approve or reject
the digital proof prior to commencement of production. (We're also happy to
send an actual sample button to you first so you can see what your finished
product will look like. The cost is $5.00 plus shipping.)
Every effort is made to produce and package your buttons in such a way as
to prevent any defective product from leaving our facility. We inspect all
our buttons 100%; however, we realize that we may still miss something or
that damage may occur in transit.
Please call us within 48 hours of receipt and we will
replace the damaged or defective product in as timely a manner as possible.
We want you to be happy and satisfied with our products and our services
and will do everything we can to make that happen!
To summarize: Our production does not begin until after you have
provided us with a written confirmation through e-mail or fax AND the order has
been paid for in full. Bullseye Buttons will provide, at no charge to you, a
digital proof of your product PRIOR TO the production run. We are also able to
provide an actual hard-copy sample for a small fee. (See
Prices page for details.) Other than
in-transit damage or product defect, our products are non-returnable
custom-produced merchandise. Please ensure your satisfaction with your order
before agreeing to its production and shipment.
COPYRIGHT POLICIES
All images on our website are protected by United States and international
copyright laws and treaties. Bullseye Buttons and/or the various artists
(Submitters) who provide content to us own all rights, including the copyrights
to that content. Bullseye Buttons and/or its Submitters reserve all rights to
the images.
Bullseye Buttons does make legal use of certain artwork obtained through its
subscriptions to various artwork suppliers and, as such, is not permitted to
re-sell any of those purchased images to customers for the customer's purpose of
inclusion in products that the customer might create.
Bullseye Buttons will not knowingly accept, alter, produce or advertise, on our
site or through our products, any image that is copyrighted, trademarked or
service marked.
By submitting an image, slogan, logo or other proprietary work to Bullseye
Buttons, you are indicating through your submission that you are the copyright
or trademark holder of such works (or have permission from the rightful
owner/holder of that copyright) and, as such, are granting us the right to
produce the image for re-sale and/or to display on our website or in any
promotional material we may distribute. Bullseye Buttons may also, with your
written consent, reproduce your submission for any other customer who would
request it.
Bullseye Buttons will investigate notices of copyright
infringement and take appropriate actions. If you believe that your work has
been used or copied in a way that constitutes copyright infringement and such
infringement is occurring on this Site or on sites linked to or from this Site,
please notify us.
Pursuant to Title 17, United States Code, Section 512(c)(3), a notification of
claimed infringement must be a written communication addressed to the designated
agent as set forth below, and must include substantially all of the following:
physical or electronic signature of the person authorized to act on behalf of
the owner of the copyright interest that is alleged to have been infringed;
description of the copyrighted work or works that you claim have been infringed
("infringed work") and identification of what material in such work(s) is
claimed to be infringing ("infringing work") and which you request to be removed
or access to which is to be disabled;
description of where the material that you claim is infringing is located on the
Site;
information sufficient to permit Bullseye Buttons to contact you, such as your
physical address, telephone number, and email address;
statement by you that you have a good faith belief that the use of the material
identified in your Notice in the manner complained of is not authorized by the
copyright owner, its agent, or the law;
statement by you that the information in your Notice is accurate and, under
penalty of perjury that you are the copyright owner or authorized to act on the
copyright owner's behalf.
